These Terms of Use (the "Terms") govern your access to and use of the website at celticpenitentiary.com (the "Site") and the walking-tour services offered by Celtic Penitentiary Tours Ltd ("Celtic Penitentiary", "we", "our", or "us"). By using the Site or booking a walk, you agree to these Terms.

1. Definitions

Service — the historic Dublin walking tours operated by Celtic Penitentiary, together with the Site at celticpenitentiary.com.
User — any person who accesses the Site or books a walk.
Content — all text, images, audio, video, route maps and other material published on the Site or used during a walk.

2. Acceptance of Terms

You must be at least 18 years old to enter into a booking with Celtic Penitentiary, or have the consent of a parent or legal guardian. By using the Site, you confirm that you meet these requirements and accept these Terms in full.

3. Description of Service

Celtic Penitentiary operates small-group, English-language walking tours through public streets and footpaths in Dublin, Ireland. Our walks are exterior only. We do not enter Kilmainham Gaol, Dublin Castle, Christ Church Cathedral, St Patrick's Cathedral, the General Post Office, the Custom House, the Four Courts, Trinity College, Bank of Ireland, or any other building referenced in our itineraries. Booking a Celtic Penitentiary walk does not include any form of interior admission.

4. User Conduct & Prohibited Uses

4.1. Walkers must follow reasonable instructions from the resident guide for safety and group cohesion.
4.2. You may not record commercial-grade video or audio of guide commentary, livestream a walk, or republish guide commentary without written consent.
4.3. You may not photograph other walkers' faces without their permission.
4.4. You may not use the Site to scrape content, send automated traffic, or attempt to compromise security.
4.5. We may decline service to anyone whose conduct presents a risk to other walkers.

5. Intellectual Property

All Content on the Site — including written copy, route maps, photography, and the company name and brand "Celtic Penitentiary" — is the intellectual property of Celtic Penitentiary Tours Ltd or its licensors and is protected by copyright. You may share short passages and individual images for non-commercial purposes with attribution and a link back to celticpenitentiary.com. All other reuse requires prior written permission.

Photography taken during walks remains the copyright of the photographer; we may use photographs of walks (without identifiable faces, or with consent) for promotional purposes on the Site and in print collateral.

6. Bookings, Cancellations, Termination

6.1. Bookings are confirmed only when we send a written confirmation by email. Until that point, an enquiry is non-binding.

6.2. Cancellation by the walker:

More than 7 days before the walk: full refund.
3 to 7 days before: 50% refund or free transfer to another date.
Less than 3 days: no refund; we will offer transfer to a date in the next 90 days where possible.

6.3. Cancellation by Celtic Penitentiary (weather, guide illness, force majeure): full refund or free re-book at your election.

6.4. We may terminate access to the Service for breach of these Terms; user-generated booking data is handled per our Privacy Policy.

7. Disclaimer of Warranties

THE SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, LIFFEY STONES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WALKING IN A CITY INVOLVES INHERENT RISKS, INCLUDING UNEVEN PAVING, WEATHER, AND TRAFFIC. WALKERS PARTICIPATE AT THEIR OWN RISK AND ARE RESPONSIBLE FOR THEIR OWN HEALTH, FITNESS, AND PERSONAL BELONGINGS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIFFEY STONES, ITS DIRECTORS, EMPLOYEES OR GUIDES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATING TO A WALK SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THAT WALK.

9. Changes to Terms

We may update these Terms from time to time. The Effective Date and Version above will change accordingly. Material changes will be announced on the Site for at least 14 days before they take effect; continued use after that date constitutes acceptance.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, USA. If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force (Severability).
